Beijing, April 25 Xinhua Law of the People 's Republic of China

(Adopted at the Second Session of the Standing Committee of the Twelfth National People 's Congress on April 25, 2013)

Article 1 This Law is formulated for the purpose of safeguarding the lawful rights and interests of tourists and tourism operators, regulating the order of the tourism market, protecting and rationally utilizing the tourism resources and promoting the sustainable and healthy development of the tourism industry.


Article 2 This Law shall apply to the activities carried out in the territory of the People's Republic of China and in the territory of the People's Republic of China, such as excursions, vacations and leisure activities organized in the territory of the People's Republic of China, and the provision of related services for tourism activities.


Article 3 The State shall develop tourism undertakings, improve the tourism public services, and protect the rights of tourists in tourism activities according to law.

Article 4 The development of tourism shall follow the principle of unity of social, economic and ecological benefits. The State encourages all kinds of market entities to make reasonable use of tourism resources according to law in the effective protection of tourism resources. The use of public resources to build the tour site should reflect the nature of public welfare.


Article 5 The State shall promote a healthy, civilized and environmentally friendly way of tourism, support and encourage all kinds of social institutions to carry out tourism public welfare publicity, and give incentives to units and individuals that have made outstanding contributions to the development of tourism.


Article 6 The State shall establish and improve the standards and rules of tourism services and prohibit monopoly and monopoly of the industry. Travel operators should be honest business, fair competition, social responsibility, for tourists to provide safe, healthy, health, convenient travel services.


Article 7 The State Council shall establish and improve a comprehensive coordination mechanism for tourism and conduct comprehensive coordination on the development of tourism.

The local people's governments at or above the county level shall strengthen the organization and leadership of tourism work, clarify the relevant departments or agencies, and coordinate the development and supervision and management of the tourism industry in their respective administrative areas.


Article 8 The tourism industry organizations established according to law shall be subject to self-management.

Chapter II Tourists

Article 9 Tourists have the right to choose their own tourism products and services, the right to refuse the travel operators of compulsory transactions.

Tourists have the right to know the real situation of the purchased travel products and services.

Tourists have the right to require travel operators to provide products and services in accordance with the agreement.

Article 10 The dignity of the tourists, national customs and religious beliefs should be respected.

Article 11 Tourists, such as persons with disabilities, the elderly and minors, enjoy the convenience and preferential treatment in accordance with the laws, regulations and relevant regulations in the tourism activities.
