Article 1 These Regulations are formulated for the purpose of strengthening the administration of scenic spots and effectively protecting and rationally utilizing scenic and scenic resources.

These Regulations shall be applicable to the establishment, planning, protection, utilization and management of second scenic spots.

Scenic areas of this Ordinance refers to ornamental, cultural or scientific value, natural landscape and cultural landscape is relatively concentrated, beautiful environment, suitable for tourism or scientific and cultural activities area.


The third countries shall carry out scientific planning, unified management, strict protection and sustainable utilization of scenic spots.

Fourth scenic areas where the local people's governments at or above the county level set scenic area management agencies, responsible for the protection of scenic spots, utilization and unified management.

Fifth departments responsible for the construction of the State Council responsible for the supervision and management of national scenic spots. Other relevant departments under the State Council shall be responsible for the supervision and administration of scenic spots in accordance with the division of functions prescribed by the state council.

The competent departments of construction of the people's governments of provinces and autonomous regions and the competent departments of scenic spots of the people's governments of municipalities directly under the central government shall be responsible for the supervision and administration of scenic spots within their respective administrative areas. The relevant departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government shall be responsible for the supervision and administration of scenic spots in accordance with the division of functions and responsibilities prescribed.


Article sixth any unit or individual has the obligation to protect scenic spots and resources, and has the right to stop and report the destruction of scenic resources.

Article ninth for the establishment of scenic spots, should be submitted to include the following content of the relevant materials:

(1) the basic situation of scenic spots and resources;

(three) the nature and protection objectives of scenic spots to be established;

(four) sightseeing conditions for scenic spots to be established;

(five) the contents and results of consultation with the owners and the owners of the land, forests and other natural resources and houses, etc., in the establishment of scenic spots.

Tenth the establishment of a national scenic area, filed by the provinces, autonomous regions and municipalities directly under the people's government, the construction administrative department of the State Council in charge of environmental protection departments and the competent forestry departments, cultural departments and other relevant departments organize demonstration, review comments submitted to the State Council for approval and announcement.


The establishment of provincial scenic area, the application made by the people's government at the county level, provincial, autonomous regional people's government building departments of municipalities directly under the central government or the people's Government of scenic area departments, jointly with other relevant departments, organize the demonstration, review comments submitted to the provincial, autonomous regions and municipalities directly under the Central People's government announced the approval of.

The legal rights and interests of the owner and the right holder of the land, forest and other natural resources and houses in the eleventh scenic spots are protected by law.

The people's Government applying for the establishment of scenic spots shall consult with the owners and the owners of the land, forests and other natural resources such as land, forests and other property in the scenic spots before they are submitted for examination and approval.

If a scenic spot is established, the owner or the owner of the property, such as land, forest and other natural resources and houses, shall be compensated in accordance with the law.
